Terms of service.

These terms cover the relationship between you (the client) and Capital City Computing LLC, a Florida limited liability company and web design studio in Tallahassee, Florida. They apply when you engage me to design, build, host or maintain a website. Anything specific to your project, including scope, page count, fee and launch date, is agreed in writing before work begins; where a written proposal and these terms disagree, the proposal wins.

What I do, and what is agreed

Design and build. A custom website, built to order and delivered live, hosted and managed by me. Scope (page count, forms, features), timeline and fee are set out in a written proposal for your project before any work starts. There is no price list and no packages, because no two of these projects have been the same size.

Hosting and upkeep. A build is delivered hosted and managed by me, so once your site is live there is a monthly fee that keeps it online, backed up, monitored and patched. It is not optional while I host the site. The only way to have no monthly fee is a source-code buyout, after which you host the site yourself. Any content-editing arrangement on top of hosting is set out in the same proposal. Monthly arrangements are month-to-month.

WordPress. When a project genuinely needs a CMS, I build custom WordPress. It carries ongoing security work whose scale depends entirely on what is already installed, so WordPress builds and WordPress upkeep are quoted per project in their own written quote. The same applies to taking over a WordPress site you already have, which includes assessing it, hardening it, and migrating it.

Own it outright. Prefer to hold the source code and host it yourself, with no ongoing relationship? Ask, and I will quote a source-code buyout. You receive the full source repository, with no strings.

Payment

Builds are invoiced 50% to start and 50% on delivery, or as set out in your proposal. A source-code buyout, if you choose one, is quoted separately. Monthly hosting and upkeep is billed in advance and runs month-to-month until you cancel. WordPress work is invoiced on the terms in its own quote. Anything you ask for beyond the agreed scope (online booking, a newsletter, translation, and the like) is quoted before it is built, never added to an invoice as a surprise. If a payment fails I will reach out before anything changes; a site on an unpaid hosting arrangement may be paused until the balance is settled.

Source code and ownership

A build delivers a live, hosted, managed website; the source repository is not included in the build fee. If you would like to own the source code and host it yourself, I will quote a buyout. There is no fixed timeline and no obligation. Static sites are plain HTML, CSS and JavaScript with no proprietary platform, so once you own the code you can host it anywhere. I keep the right to reuse general techniques, code patterns and know-how across projects; I never reuse your content, branding or design.

Your domain and content

Your domain stays registered in your own account and in your name. I never take possession of it. When I host your site you choose how DNS is handled: delegate your domain’s nameservers to my managed Cloudflare account, grant me limited delegated access to your existing registrar or DNS provider so I can set the records for you, or take the exact records from me and add them yourself. In every case the domain remains yours.

You are responsible for the content you give me (text, images, logos) and you confirm you have the right to use it. You grant me the licence needed to build and operate your site, and you agree it will not be used for anything illegal or for content you do not hold the rights to.

Cancellation and term

Monthly arrangements are month-to-month. Cancel any time with 30 days’ written notice, which means an email. There is no fixed term and no early-termination fee. Payments already made are non-refundable and the current month is not pro-rated. Because your domain was always registered to you, there is nothing to transfer back: I hand off DNS (releasing the managed Cloudflare account or revoking any delegated access) and waive any future fees. Unless you have purchased a source-code buyout, the hosted site comes down when you cancel, but your domain and your content always remain yours. No awkward retention call.

Uptime and support

Hosted sites run on Cloudflare and/or Cloudways with a target of 99.9% uptime. Where your agreement includes content edits, routine text and image changes go live within 24 to 48 hours of your request; larger structural changes get a written turnaround date before work starts. Brief interruptions for maintenance, or caused by upstream providers outside my control, do not count against the uptime target. If you ever feel I have fallen short, tell me. I would rather make it right than lose you.

Warranty and liability

I build carefully and stand behind the work, but the site is provided “as is,” without warranties. I am not liable for indirect or consequential losses (lost profits, lost data, or business interruption), and total liability for any claim is limited to the fees you paid in the preceding twelve months. Nothing here limits liability that cannot be limited by law.

Changes to these terms

If these terms are updated, the date at the top of the page changes with them. Material changes that affect an active engagement are sent to you by email first.

Governing law

These terms are governed by the laws of the State of Florida, and any dispute will be handled in the courts of Leon County, Florida. I would always rather talk it through first.
