Terms of Service.
Plain English. The same honesty we put on the rest of the site: what you get, what it costs, and how cancellation works.
These terms cover the relationship between you (the client) and Capital City Computing LLC, a Florida limited liability company and web design studio in Tallahassee, Florida ("we," "us," "our"). They apply when you engage us to design, build, host, or maintain a website. Anything specific to your project (scope, page count, launch date) is agreed in writing before work begins; where a written proposal and these terms disagree, the proposal wins.
Builds & care plans
Static builds (recommended). A custom static website, hosted and managed by us. The Standard build is up to 5 pages plus a contact form for $750; the Large build is up to 15 pages plus two form types for $1,500, with additional pages at $100 each. The build fee delivers a live, hosted, managed website — not the source repository (see "Source code & ownership" below).
Care plans (optional, monthly). Once your site is live you can add monthly care: the Essential plan (managed hosting, $45), the Content plan (edits only, up to 5 updates per month, $79), the Complete plan (hosting + edits, $119), or Unlimited (hosting + unlimited edits, one active request in the queue at a time, $229). The Unlimited plan also includes a branded Automated Assistant: an on-site chat widget that answers common visitor questions from answers you provide. It runs locally on your site and is not an AI or LLM service, so it only ever returns answers you supply and never invents them. Care plans are month-to-month.
WordPress. When a project genuinely needs a CMS, we build custom WordPress from $750, quoted by scope. Because WordPress requires ongoing security work, it has its own care plans: Essential (hosting & security, $69), Content (edits only, $79), Complete (hosting + edits, $139), and Unlimited ($259, which also includes the branded Automated Assistant described above). Already have a WordPress site? A one-time onboarding & security audit ($150) covers assessing, hardening, and migrating it to our managed hosting, after which a WordPress care plan applies.
Own it outright. Prefer to hold the source code and host it yourself, with no ongoing relationship? We'll quote a source-code buyout — just ask. You receive the full source repository, with no strings.
Payment
Builds are invoiced 50% to start and 50% on delivery, or as set out in your proposal; a source-code buyout, if you choose one, is quoted separately. Care plans are billed monthly in advance and run month-to-month until you cancel. The one-time WordPress onboarding & security audit ($150) is invoiced up front and is non-refundable. Any extras you ask for (online booking, a newsletter, translation, and the like) are quoted per project. If a payment fails, we'll reach out before anything changes; a site on an unpaid hosting plan may be paused until the balance is settled.
Source code & ownership
A build delivers a live, hosted, managed website; the source repository is not included in the build fee. If you'd like to own the source code and host it yourself, we'll quote a buyout — just ask; there's no fixed timeline or obligation. Static sites are plain HTML, CSS, and JavaScript with no proprietary platform, so once you own the code you can host it anywhere. We retain the right to reuse general techniques, code patterns, and know-how across projects; we never reuse your content, branding, or design.
Your domain & content
Your domain stays registered in your own account and in your name. We never take possession of it. When we host your site, you choose how DNS is handled: (a) delegate your domain's nameservers to our managed Cloudflare account, (b) grant us limited delegated access to your existing registrar or DNS provider so we can set the records for you, or (c) take the exact records from us and add them yourself. In every case the domain remains yours. You're responsible for the content you give us (text, images, logos) and you confirm you have the right to use it. You grant us the license needed to build and operate your site, and you agree the site won't be used for anything illegal or for content you don't have the rights to.
The Benchmark Guarantee
On launch day we benchmark your new site against your old one: load time, mobile performance, and Core Web Vitals. If our build doesn't beat your previous site across the board, your first three months are free. This guarantee applies when you're replacing an existing site that we can measure; new businesses without a prior site aren't eligible, for the obvious reason that there's nothing to compare against.
Cancellation & term
Care plans are month-to-month — cancel any time with 30 days' written notice, just email us. There's no fixed term and no early-termination fee. Payments already made are non-refundable and the current month isn't pro-rated. Because your domain was always registered to you, there's nothing for us to transfer back: we hand off DNS (releasing our managed Cloudflare or revoking any delegated access) and waive any future fees. Unless you've purchased a source-code buyout, the hosted site comes down when you cancel, but your domain and your content always remain yours. No awkward retention call — just let us know.
Uptime & support
Hosted sites (any static or WordPress care plan) run on Cloudflare Workers/Cloudways with a target of 99.9% uptime. Routine content and image edits are covered by a Content Edits or Unlimited plan and go live within 24–48 hours of your request; larger structural changes get a written turnaround date before work starts. Brief interruptions for maintenance or caused by upstream providers outside our control don't count against the uptime target. If you ever feel we've fallen short, tell us. The Benchmark Guarantee is the remedy on offer, and we'd rather make it right than lose you.
Warranty & liability
We build carefully and stand behind our work through the guarantees above, but beyond those the site is provided "as is," without other warranties. We're not liable for indirect or consequential losses (lost profits, lost data, or business interruption), and our total liability for any claim is limited to the fees you paid us in the preceding twelve months. Nothing here limits liability that can't be limited by law.
Changes to these terms
If we update these terms, we'll change the date at the top of the page. Material changes that affect an active engagement will be sent to you by email first.
Governing law
These terms are governed by the laws of the State of Florida, and any dispute will be handled in the courts of Leon County, Florida. We'd always rather talk it through first.
